TERMS OF SERVICE
OVERVIEW
This website is operated by Stephanie Carr trading as Brickwork Orange (“Brickwork Orange”, “we”, “us” or “our”), a New Zealand sole trader.
These Terms of Service apply to your use of our website and to purchases made from Brickwork Orange. By accessing our website or placing an order, you agree to these Terms of Service.
Nothing in these Terms limits or excludes any rights you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable New Zealand law that cannot legally be excluded.
1. OUR PRODUCTS
Brickwork Orange sells a mixture of new, pre-loved, retired and discontinued LEGO® sets, minifigures, parts, accessories, display items, custom creations and related products.
Because some of our products are pre-loved, their condition may vary. Products may show signs of previous use, age, storage or handling. Packaging, instructions, stickers and other components may also show wear or may not be included.
We aim to describe the condition and completeness of each product accurately. Where we know that a set or item is incomplete, damaged, modified or has another material condition issue, we will endeavour to disclose this in the product listing.
Product photographs and descriptions form part of the information provided about an item. Please review them carefully before purchasing.
Colours may appear slightly different depending on your screen or device.
2. PRODUCT COMPLETENESS AND CONDITION
Unless a listing states that a pre-loved LEGO® set has been checked and confirmed as complete, you should not assume that every original piece, spare piece, sticker, instruction booklet, minifigure, accessory or item of packaging is included.
Any known significant missing pieces or defects identified by us will be disclosed where reasonably practicable.
The age, price, disclosed condition and nature of a pre-loved product will be relevant when assessing its condition. Nothing in this section limits your rights under the Consumer Guarantees Act 1993.
3. ORDERS
When you place an order, you are making an offer to purchase the products in your cart.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, incorrectly priced, incorrectly described due to an error, or where we reasonably suspect fraudulent activity.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.
As many pre-loved and retired products are one-off items, availability cannot always be guaranteed until your order has been processed.
4. PRICING AND PAYMENT
All prices displayed on our website are in New Zealand dollars (NZD) unless otherwise stated.
Shipping or delivery charges, where applicable, will be shown during checkout before you complete your purchase.
Payment must be made using one of the payment methods offered at checkout.
We reserve the right to correct genuine pricing or listing errors. If an error affects an order you have already placed, we will contact you before proceeding where appropriate.
5. SHIPPING AND DELIVERY
We currently ship within New Zealand.
Shipping costs and available delivery options are displayed at checkout. Delivery times are estimates and may be affected by courier delays, public holidays, weather, rural delivery or other circumstances outside our reasonable control.
We will package orders with reasonable care and are responsible for meeting our obligations relating to delivery under applicable New Zealand consumer law.

6. AUCKLAND PICKUP
Pickup is available from one designated Auckland pickup location where this option is offered at checkout.
Pickup is by arrangement only. We will provide pickup instructions and location details once your order is ready for collection.
Please do not attempt to collect an order until you have received confirmation that it is ready.
7. RETURNS, REFUNDS AND PROBLEMS WITH AN ORDER
Returns, refunds and remedies are handled in accordance with our Return and Refund Policy and applicable New Zealand consumer law.
We do not generally offer returns simply because you have changed your mind. However, this does not affect any rights or remedies you may have under the Consumer Guarantees Act 1993 or other applicable law.
If an item arrives damaged, materially different from its description, or there is another problem with your order, please contact us as soon as reasonably possible so we can help resolve the issue.
8. CUSTOM AND PERSONALISED PRODUCTS
Some products may be custom-made, personalised or created to order.
Please check any names, wording, colours, specifications or other information you provide carefully before confirming your order.
Because personalised or custom-made items are created specifically for you, we do not generally accept change-of-mind returns for these products.
This does not limit your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand law where a product is faulty, not as described or otherwise fails to meet a statutory guarantee.
9. SELLING LEGO® TO BRICKWORK ORANGE
Any purchase by Brickwork Orange of pre-loved LEGO® or related items from you is subject to separate agreement between you and Brickwork Orange.
Submitting details, photographs or information through our website does not oblige Brickwork Orange to purchase the items offered.
We may accept or decline an offer to sell to us at our discretion and may request further information before making an offer.
10. WEBSITE INFORMATION
We aim to keep information on our website accurate and current, but occasional errors or omissions may occur.
We may update product information, availability, pricing and other website content where necessary.
Nothing in this section allows us to avoid obligations imposed by applicable New Zealand consumer law.
11. INTELLECTUAL PROPERTY
Unless otherwise stated, the original content, branding, graphics, photographs and other material created by or for Brickwork Orange on this website are owned by or licensed to Brickwork Orange and may not be reproduced or commercially used without permission.
LEGO® is a trademark of the LEGO Group.
Brickwork Orange is an independent business and is not affiliated with, endorsed by, sponsored by or associated with the LEGO Group.
References to LEGO® and related product names are used for identification and descriptive purposes.
12. ACCEPTABLE USE
You must not use our website for unlawful, fraudulent or malicious purposes, attempt to interfere with its security or operation, introduce malicious software, or use the website in a way that infringes the rights of Brickwork Orange or another person.
13. THIRD-PARTY SERVICES
Our website is hosted using Shopify and may use third-party services for payments, shipping, communications and other functions.
Your use of some third-party services may also be subject to the relevant provider's terms and privacy practices.
Brickwork Orange remains responsible for its obligations to you under applicable New Zealand law.
14. PRIVACY
Personal information collected through our website is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

15. LIABILITY
To the extent permitted by law, Brickwork Orange is not responsible for losses that are indirect or not reasonably foreseeable as a result of your use of our website or products.
Nothing in these Terms excludes, restricts or modifies any right or remedy available to you under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable law where it would be unlawful to do so.
16. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time, for example to reflect changes to our business, website or legal obligations.
The version published on our website at the time you place an order will generally apply to that order, subject to applicable law.

These Terms are governed by the laws of New Zealand.
